Selected Photographs
After careful review of all images taken during your session, Photographer will edit and present only those photographs that, in Photographer’s sole judgment, best represent the quality and standard of Maine Parris Photography. The number of delivered images corresponds to your selected session package unless otherwise agreed upon in writing.
Retainer & Payment
A non-refundable $150 retainer is required at the time of booking to secure your session date. No date is confirmed without a received retainer, verbal agreements or email discussions do not hold your date. The remaining session balance is due in full on the day of your session prior to the start of shooting. Applicable sales tax may apply.
Cancellations & Refunds
All retainers are non-refundable as they secure your specific date and time on my calendar. Once a session fee is paid in full, refunds are not issued. If you need to reschedule for emergency purposes, your payment will be applied toward a future session date.
The One-Pass Rule:
Each client is granted one complimentary reschedule for emergency purposes. A second reschedule requires a new retainer to secure a new date.
Inclement Weather
If a session must be rescheduled due to extreme heat, rain, or severe weather, there is no rescheduling fee. Weather-related reschedules will be moved to the next available opening, which may be up to 4 weeks from the original session date. If you choose to cancel rather than reschedule due to weather, the retainer is forfeited.
Punctuality
Your session time is reserved exclusively for you. Please arrive on time and ready to begin. Arriving more than 30 minutes late may result in forfeiture of your session and all payments made. Please limit attendance to those being photographed plus one guest to minimize distraction.
Session Fees
Session fees are due in full before the start of your scheduled session. Once a session fee is paid in full it is non-refundable. Credits may be applied toward a rescheduled session in qualifying circumstances as outlined above.
Turnaround Time
Standard turnaround is 2 weeks from the date final image selections are submitted. Expedited editing is available for an additional fee: 7-day turnaround for $99, 3-day turnaround for $199. Expedited requests must be made at the time of booking. No sneak peeks are offered at this time.
Image Delivery & Gallery Expiration
Your final edited images will be delivered via a private, password-protected online gallery. Your gallery will remain active for 60 days from the delivery date. Please download and back up your images promptly. Gallery reactivation after expiration may be available for a small fee upon request.
Copyright
As the author of all photographs made pursuant to this agreement and as provided by law, Photographer retains the copyright in and to all photographs. The parties agree that the photographs are not works made for hire in accordance with 17 U.S.C. § 101. Photographer retains all exclusive rights provided by 17 U.S.C. § 106, including the rights to reproduce, prepare derivative works, distribute, and publicly display the photographs.
Client’s Use of Photographs
Client may use the photographs for personal, non-commercial purposes including display on personal websites and sharing with family and friends. Where customary, credit should be given to the Photographer as “© Maine Parris Photography.” Client agrees not to permit or assist with any commercial use or sale of the photographs without specific written consent from Photographer.
Model Release
By booking a session, Client grants Maine Parris Photography and its heirs, legal representatives, and assigns the irrevocable, perpetual, and unrestricted right to use session photographs in all forms and media for advertising, promotion, portfolio display, and other lawful purposes. Client waives any right to royalties or compensation arising from such use and releases Photographer from liability related to the use of said photographs.
Clients who prefer to opt out of the model release may do so by notifying Photographer in writing at the time of booking.
Liability
Photographer’s liability for any loss, damage, or failure to deliver photographs, including circumstances resulting from acts of God, equipment failure, accident, illness, or unpredictable misfortune, shall be limited to the payments made under this agreement.
Retention of Photographs
Photographer will retain copies of session photographs for a minimum of 90 days following the session date.
